Certificate forgery: Saleh dismisses Appeal Court judgment, heads to Supreme Court. By Ali Adoyi on February 8, 2016

Despite Monday’s judgment of the Appeal Court
that set aside the verdict of the Federal High
Court in a case brought before it by Chris
Adabah Abah, lawmaker representing Ogbadibo,
Ado and Okpokwu federal constituency, Hassan
Saleh will continue to represent the
constituency.
DAILY POST reports that the judgment was
greeted with a huge celebration by Abah’s
supporters in Ogbadibo Local Government Area.
But Hassan has dismissed the celebration,
saying such was in frivolity as the judgment
provided two options which are for him to either
approach the Supreme Court or return to the
High Court for fresh trials.
He further cleared that it implies that he would
remain on seat pending the determination of the
case at the Supreme where he will likely appeal
the judgment.
In a statement issued and signed by the reps
member, he said the Monday’s jubilation was
needless, asserting that after due consultation
with his lawyers, he has resolved to appeal the
case at the Supreme Court.
The statement below:
‘’My attention has been drawn to the needless
jubilations and its attendant public disturbances
in Ogbadibo Local Government Area by some
supporters of my opponent over the ‘black
market’ judgment secured at the Court of Appeal
earlier today.
‘’It is also very pertinent to address the
misinformation and misrepresentation of the
decision of the Court of Appeal.
‘’For the records, my opponent, Chris Adaba
Abbah whose election was nullified by the
Federal High Court, Abuja, on the premises of
certificate forgery and perjury approached the
court of Appeal to set aside the decision of the
lower court and allow a retrial, which was
resolved in his favour.
‘’The court of Appeal couldn’t have exonerated
him of certificate forgery and perjury which are
the nucleus of the matter. What the ruling of
Appellant court has done today is to leave us
with two options of either appealing against the
judgment or go back to the Federal High Court
for a fresh trial.
‘’I have duly consulted my team of Lawyers and
in no time, we shall approach the Supreme Court
and appeal against the decision of the Court of
Appeal, which is alien to any legal authority in
Nigeria and all over the world.
‘’It is a miscarriage of justice and with God on
our side, we shall triumph and remain victorious.
‘’I, therefore, urge my teeming supporters and
respected constituents to remain calm and law
abiding. We should rather remain focused and
committed to the course of justice. I am still a
Member of the House of Representatives and it
shall remain so by the power of God.

On Monday 8th February 2016, Justice Lawal-
Akapo of the Lagos High Court dismissed the
application of The Synagogue, Church Of All
Nations (SCOAN) engineers to forestall trial
pending the outcome of an appeal they had
earlier submitted.
This comes on the heels of the Lagos State
government, through its Attorney General,
admitting to committing a judicial slip by
predicating its legal action against the engineers
on the coroner’s verdict of 2015.
Fundamental issues raised in the judicial review
by The SCOAN lawyers included a prayer seeking
to determine whether or not the Magistrate
Oyetade Komolafe-led coroner’s inquest was a
creation of law.




It would be recalled that while delivering his
verdict on the coroner’s inquest, Magistrate
Oyetade Komolafe ruled that Alimosho Coroner’s
District was a creation of law despite a careful
review of the Lagos State Coroner’s system
revealing no such district existed
The legal implications of this include all the
recommendations of the controversial coroner
amounting to a nullity in law.
Even though the Lagos State Government agreed
through its Attorney General and Commissioner
for Justice, Mr Adeniji Kazeem, to have
committed a legal error, it has not apologised or
withdrawn the case against the engineers.
“The ruling of Justice Alogba dismissing the
application of the engineers amounts to an
infringement on their rights to fair hearing,” a
lawyer told newsmen outside the court premises.
Justice Akapo fixed February 18, 2016 for the
continuation of the trial.
It would be recalled that The SCOAN has
persistently maintained its stance that the
collapse was as a result of sabotage while the
Lagos State Government declared structural
failure was behind the tragedy.

The Sultan of Sokoto, Alhaji Sa’ad Abubakar III,
has admonished Muslim and Christian Clerics in
the country to always tell leaders the truth.
The News Agency of Nigeria reports that
Abubakar spoke on Sunday in Tsamiya village in
Tureta Local Government Area of Sokoto State
when he inaugurated an Islamiya School
constructed by an indigene of the village who
wants to be anonymous.
Abubakar said: “Religious leaders should tell us
the truth.
“We should be told when we do the right thing
and we should be told when we go astray.
“This is better for us as such efforts should
guide us, rather than praise singing to us and
sycophancy.”
Abubakar also appealed to parents across the
country to endeavour to enrol their children in
schools at all levels.
He said: “Education is the best legacy we can
bequeath to our children and wards.
“It is also only with education that any society
can develop and without it, there will be no any
meaningful development.”
The monarch also commended the state
government for according top priority to the
education sector.
Governor Aminu Tambuwal, who was represented
by the Secretary to the State Government, Prof.
Bashir Garba, said his administration would
continue to accord priority attention to the
education sector.
